1. Opening

1.1 MEETING OPENING AND PRAYER

The Chief Executive Officer opened the meeting with a prayer at 6.04pm.

1.2 ACKNOWLEDGMENT OF TRADITIONAL OWNERS STATEMENT

On behalf of the City of Whittlesea the Mayor recognised the rich Aboriginal heritage of this country and acknowledged the Wurundjeri Willam Clan as the Traditional Owners of this place.

4.1 Notice of Motion 860 - Rescission of Council Resolution - Item 6.1.9 Review of Participation – Municipal Association of Victoria and Victorian Local Government Association

THAT Council resolve to rescind the resolution made at the Council Meeting held on 2 October 2018 in relation to item 6.1.9 – Review of Participation – Municipal Association of Victoria and Victorian Local Government Association which reads:

“That Council resolve to consider membership of the Municipal Association of Victoria (MAV) and the Victorian Local Governance Association (VLGA) for the 2018-2019 year, after the outcome of the invitation to the respective organisation CEO’s to present at Council Forum on the benefits of membership to the City of Whittlesea.”

Councillor Cox entered the Council Chamber at 6:16 pm prior to the vote on this item.

4.2 Notice of Motion 861 - Review of Participation – Municipal Association of Victoria and Victorian Local Government Association

THAT Council resolve to renew membership of the Municipal Association of Victoria (MAV) and the Victorian Local Governance Association (VLGA) for the 2018-2019 year immediately.

Notice of Motion No. 861 – Review of Participation – Municipal Association of Victoria and Victorian Local Government Association, lapsed due to the Rescission Motion listed at Item 4.1 on this Agenda being lost.

4.3 Notice of Motion 862 - Rescission of Council Resolution Cr Lalios Leave of Absence

MOtion

THAT Council resolve to rescind the resolution made at the Council Meeting held on 2 October 2018 in relation to leave of absence for Cr Lalios which reads:

“THAT Cr Lalios’ request for leave of absence for this meeting be granted.”

Mayors ruling

The Mayor, Cr Pavlidis advised Councillors that Notice of Motion 862 – Rescission of Council Resolution Cr Lalios Leave of Absence and subsequent Notice of Motion 863 - Cr Lalios Leave of Absence cannot validly be accepted and considered by Council.

Councillors have been provided with a confidential memorandum from the Chief Executive Officer dated 11 October 2018 which provides further advice in relation to this matter.

4.4 Notice of Motion 863 - Cr Lalios Leave of Absence

MOtion

THAT Council resolve to accept Cr Lalios’ leave of absence for the Council meeting of 2 October 2018 and note that Cr Lalios had complied with the requirements of the Local Government Act 1989, in requesting leave.

Chief Executive Officer Explanatory Note

Notice of Motion No. 863 Cr Lalios Leave of Absence, lapsed due to the Mayor making a ruling that the Rescission Motion listed at Item 4.3 on this Agenda cannot validly be accepted and considered by Council.
